1. About B-Bot

B-Bot is an AI-powered business assistant operated by B-Bot Cloud ("we", "us", "our"), a business based in George, Western Cape, South Africa. B-Bot is accessible via WhatsApp and uses artificial intelligence to respond to customer queries on behalf of businesses.

2. Acceptance of Terms

By initiating a conversation with B-Bot via WhatsApp, you confirm that:

• You are at least 13 years of age
• You have read and agree to these Terms of Service
• You agree to our Privacy Policy
• Your use of WhatsApp complies with WhatsApp's Terms of Service

3. Use of the Service

B-Bot is provided to assist with business-related queries and information. You agree to use B-Bot only for lawful purposes and in a manner consistent with these Terms. You agree not to:

• Use B-Bot for any illegal, harmful, or fraudulent activity
• Attempt to manipulate, deceive, or exploit the AI system
• Send spam, unsolicited messages, or abusive content
• Attempt to reverse-engineer, copy, or replicate B-Bot's underlying systems
• Use B-Bot in any way that could damage, disable, or impair our infrastructure

4. AI-Generated Responses

B-Bot's responses are generated by artificial intelligence and are provided for informational and assistance purposes only. You acknowledge that:

• AI responses may not always be accurate, complete, or up to date
• B-Bot's responses do not constitute professional advice (legal, financial, medical, or otherwise)
• You should verify important information independently before acting on it
• We are not liable for decisions made based solely on B-Bot's responses

5. WhatsApp & Meta

B-Bot operates through the WhatsApp Business API provided by Meta Platforms, Inc. Your use of WhatsApp is governed by Meta's own terms and policies, which are independent of these Terms. We are not responsible for WhatsApp's service availability, changes to the platform, or Meta's policies.

6. Intellectual Property

All content, branding, software, and systems associated with B-Bot are the intellectual property of B-Bot Cloud. You may not reproduce, distribute, or create derivative works from any part of B-Bot without our express written permission. Conversation content you submit remains yours, but you grant us a limited licence to process it for the purpose of providing the service.

7. Availability & Modifications

We strive to keep B-Bot available at all times, but we do not guarantee uninterrupted access. We reserve the right to:

• Modify, suspend, or discontinue B-Bot (or any feature) at any time, with or without notice
• Update these Terms of Service at any time — continued use after changes constitutes acceptance
• Restrict or terminate access for users who violate these Terms

8. Limitation of Liability

To the fullest extent permitted by applicable law, B-Bot Cloud shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, B-Bot. Our total liability for any claim arising under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim (if any).

9. Indemnification

You agree to indemnify and hold harmless B-Bot Cloud, its directors, employees, and agents from any claims, losses, damages, or expenses (including legal fees) arising from your use of B-Bot or your violation of these Terms.

10. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms or your use of B-Bot shall be subject to the exclusive jurisdiction of the courts of South Africa.

11. Data & Privacy

Your use of B-Bot is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand how we collect, use, and protect your information.

12. Refund & Money-Back Guarantee Policy

14-Day Money-Back Guarantee

B-Bot Cloud offers a 14-day money-back guarantee on setup fees (Milestone 1 deposit). If you are not satisfied with the initial consultation and website analysis delivered within the first 14 days of your deposit payment, you may request a full refund of your deposit.

Eligibility

To qualify for a refund under the money-back guarantee:

• The refund request must be submitted within 14 calendar days of the deposit payment date.
• You must provide a reason for the refund request via email to billing@b-bot.cloud.
• If bot development (Milestone 2) has already been completed and approved by you, the deposit is no longer eligible for a refund.

Refund Process

Approved refunds are processed within 5-10 business days and returned to the original payment method. You will receive an email confirmation once the refund has been initiated.

Monthly Subscription Cancellation

Monthly subscription payments are non-refundable for the current billing period. You may cancel your subscription at any time, and access will continue until the end of the current billing cycle. No further charges will be applied after cancellation.

Non-Refundable Items

The following are not eligible for refunds:

• Milestone 2 (Build & Review) payments after bot delivery and approval.
• Milestone 3 (Go-Live) payments once the bot has been deployed.
• WhatsApp Business API setup fees (third-party costs).
• Custom development or add-on work completed and delivered.
